Welcome to the ICCC Montréal website (the “Site”). By accessing or using the Site, you agree to these Terms of Use (the “Terms”). If you do not agree, please do not use the Site.

These Terms form a legally binding agreement between you and ICCC Montréal (“ICCC,” “we,” “us,” or “our”). You should also read our Privacy Policy and Cookie Policy, which explain how we handle personal information and cookies.

1) Who we are and how to contact us

2) Eligibility & user responsibilities

  • You must be at least the age of majority in your province/territory (18 in Québec) to make purchases, donations, or register for events.

  • You agree to provide accurate information and to keep your contact details up to date.

  • If you create an account (where offered), keep your credentials confidential and notify us immediately of any unauthorized use.

3) Permitted use of the Site

You may browse, link to, and share public pages of the Site for lawful, non‑commercial purposes. You agree not to:

  • break the law, infringe intellectual property rights, or violate privacy or publicity rights;

  • upload or transmit malware, scraping tools, or automated bots that degrade or disrupt the Site;

  • attempt to probe, scan, or test the vulnerability of the Site or bypass security measures;

  • use the Site to harass, defame, or harm others, or to post illegal, obscene, or hateful content.

We may suspend or terminate access if we believe your use violates these Terms or applicable law.

4) Content and intellectual property

  • All content on the Site—including text, graphics, logos, photos, videos, and designs—is owned by ICCC Montréal or our licensors and is protected by copyright, trademark, and other laws.

  • Unless we say otherwise in writing, you may not copy, reproduce, republish, mirror, frame, sell, or exploit any part of the Site for commercial purposes.

  • ICCC names and logos are our trademarks. You may not use them without our prior written permission.

5) Your submissions and user content

If you submit content (e.g., comments, testimonials, photos from events, or materials via forms):

  • You represent that you own or have the rights to the content and that it does not violate anyone else’s rights.

  • You grant ICCC a worldwide, royalty‑free, non‑exclusive license to host, reproduce, display, and distribute your content for the purpose for which it was submitted and to operate, promote, and improve the Site and our programs.

  • We may remove or refuse content at our discretion.

6) Events, registrations, donations, and purchases

  • Events/registrations: Some events may have separate terms, codes of conduct, or waivers. If there’s a conflict, those event‑specific terms apply to that event.

  • Donations & payments: Donations and purchases (if offered) are processed by third‑party payment processors. By proceeding, you agree to their terms and privacy policies. Unless stated otherwise, donations are non‑refundable to the fullest extent permitted by law.

  • Currency & taxes: Amounts are shown in Canadian dollars (CAD) unless we say otherwise. You are responsible for any applicable taxes, charges, or bank/foreign exchange fees.

  • Receipts: We provide receipts via email; keep them for your records.

7) Third‑party services and links

The Site may include links or integrations with services that we don’t operate (e.g., ticketing, video platforms, email subscription tools, social media, analytics, or map embeds). We aren’t responsible for their content, security, or privacy practices. Review their terms and policies before using those services.

8) Privacy and cookies

Your use of the Site is also governed by our Privacy Policy and Cookie Policy, which explain what personal information we collect, why, and how we use cookies and similar technologies. Where required (e.g., in Québec or the EU/EEA), non‑essential cookies will only run with your opt‑in consent, and you can adjust preferences via the cookie banner or footer link.

10) No warranties (Site provided “as is”)

We work hard to keep the Site accurate, available, and secure, but we do not guarantee it will be uninterrupted, error‑free, or free of harmful components. The Site and all content are provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose and non‑infringement. Where the law does not allow disclaimers, they will apply only to the extent permitted.

11) Limitation of liability

To the fullest extent permitted by law, ICCC and our directors, officers, employees, and volunteers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, use, goodwill, or other intangible losses, arising from or related to your use of (or inability to use) the Site, even if we were advised of the possibility of such damages.

If we are found liable, our total liability to you for all claims arising out of or relating to the Site or these Terms will not exceed the greater of (a) CAD $100 or (b) the amounts (if any) you paid to us for the service that gave rise to the claim in the 3 months before the event giving rise to liability.

Some jurisdictions do not allow certain limitations; in those cases, these limits apply only to the extent permitted by law.

12) Indemnification

You agree to defend, indemnify, and hold harmless ICCC and our directors, officers, employees, and volunteers from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your access to or use of the Site; (b) your content or submissions; (c) your violation of these Terms or applicable law; or (d) any actual or alleged infringement or misappropriation by you of any third‑party rights.

13) Changes to the Site or these Terms

We may modify the Site and these Terms from time to time. If we make material changes, we will post the updated Terms and update the “Last updated” date above. Your continued use of the Site after changes take effect means you accept the revised Terms.

14) Termination

We may suspend or terminate your access to the Site at any time, including if we believe you have violated these Terms or the law. You may stop using the Site at any time. Sections that, by their nature, should survive termination will do so (e.g., intellectual property, disclaimers, limitations of liability, indemnity, and governing law).

15) Governing law and venue

These Terms are governed by the laws of the Province of Québec and the federal laws of Canada applicable in Québec, without regard to conflicts of laws principles. You agree to the exclusive jurisdiction of the courts located in Montréal, Québec, for any dispute arising out of or relating to these Terms or the Site.

16) Language / Langue

English version controls. You may request a French version; if a French translation is provided, the English version will control in case of conflict.

17) Copyright & notice procedure (for online materials)

If you believe content on the Site infringes your copyright, please email office@icccmtl.com with: (1) your contact details; (2) a description of the copyrighted work; (3) a description of where the allegedly infringing material is located on the Site; (4) a statement that you have a good‑faith belief the use is not authorized; and (5) a statement that the information is accurate and that you are the copyright owner or authorized to act on their behalf.

18) Export & sanctions compliance

You agree not to use the Site in violation of applicable export control, sanctions, or anti‑boycott laws. You also represent that you are not located in a country or on a list subject to comprehensive sanctions.

19) Force majeure

We are not liable for any delay or failure to perform due to events beyond our reasonable control, including acts of God, labor disputes, internet outages, cyberattacks, government actions, war, epidemics, or natural disasters.

20) Entire agreement; severability; no waiver

These Terms (plus any supplemental terms we present for specific features or events) are the entire agreement between you and ICCC regarding the Site. If any provision is found unenforceable, the remainder will continue in effect. Our failure to enforce a provision is not a waiver of our right to do so later.
